Seekr Terms and Conditions

Welcome to Seekr! These terms and conditions ("Terms") govern your use of Seekr's website, mobile application, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

1. Nature of the Platform

Seekr is a peer-to-peer marketplace that connects individuals seeking assistance with tasks ("Clients") with individuals offering to perform such tasks ("Taskers"). Seekr provides the Platform as a venue for Clients and Taskers to connect and does not employ, endorse, or control any Taskers or Clients.

Seekr acts solely as a technology provider and does not supervise, direct, or control the services performed by Taskers. Any agreements made between Clients and Taskers are solely between those parties. Seekr does not provide any guarantees or warranties regarding the quality, safety, legality, or reliability of services provided by Taskers.

2. No Responsibility for User Conduct

Seekr acts solely as a facilitator and is not a party to any agreements entered into between Clients and Taskers. Accordingly:

  • Seekr does not verify the identity, background, qualifications, or certifications of Taskers or Clients. Users are solely responsible for conducting their own due diligence.
  • Seekr does not guarantee the suitability, legality, quality, or ability of any Tasker or the accuracy of any services provided.
  • Seekr is not responsible for any disputes, claims, losses, injuries, or damages of any kind that may arise from interactions between Clients and Taskers, including but not limited to: property damage, personal injury, or breach of contract.
  • Seekr disclaims all liability for any misconduct, illegal acts, or negligence by any user of the Platform.

    • You acknowledge and agree that all interactions and transactions are at your own risk. Seekr strongly encourages users to independently verify any information and perform adequate background checks before engaging with others on the Platform.

    3. User Eligibility

    By using the Platform, you represent and warrant that:

  • You are at least 18 years old and have the legal capacity to enter into binding agreements.
  • You will use the Platform in compliance with these Terms and all applicable laws and regulations in India.
  • You will not use the Platform if you have been previously suspended or removed by Seekr for any reason.

    • 4. User Accounts

    To access certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of your login credentials.
  • Be solely responsible for all activities that occur under your account.

    • Seekr reserves the right to suspend or terminate accounts that violate these Terms or for any other reason at its sole discretion. Users are prohibited from creating multiple accounts, impersonating other individuals or entities, or misrepresenting their affiliation with any person or entity.

    5. Payment Terms

    All payments for tasks are facilitated through the Platform. Seekr:

  • Charges a service fee for facilitating transactions between Clients and Taskers.
  • Does not guarantee the accuracy or security of payments or refunds.
  • Is not liable for any disputes, chargebacks, or discrepancies arising between Clients and Taskers regarding payments.

    • Taskers and Clients are solely responsible for complying with any tax obligations, including Goods and Services Tax (GST) or other applicable taxes in India. Seekr is not responsible for calculating, collecting, or remitting taxes on behalf of users.

    6. Prohibited Activities

    Users agree not to:

  • Violate any applicable laws, regulations, or ordinances, including those of India.
  • Post false, misleading, defamatory, or unlawful content on the Platform.
  • Engage in harassment, abuse, or discriminatory behavior toward other users.
  • Use the Platform to solicit, advertise, or promote any illegal or unauthorized activities.
  • Impersonate any individual or entity or misrepresent your affiliation with any individual or entity.

    • Seekr reserves the right to investigate and take appropriate legal action, including account suspension or termination, against anyone who violates these Terms.

    7. Disclaimers and Limitation of Liability

  • The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • Seekr disclaims all liability for any actions, errors, omissions, or conduct of Clients, Taskers, or third parties in connection with the Platform.
  • Seekr is not responsible for any damage to property, personal injury, or other harm resulting from the use of the Platform.
  • To the maximum extent permitted by law, Seekr's liability is limited to the fees paid by you to Seekr in connection with your use of the Platform.
  • Under no circumstances will Seekr be liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or profits.

    • 8. Indemnification

    You agree to indemnify, defend, and hold harmless Seekr, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of the Platform.
  • Your violation of these Terms or applicable laws.
  • Your interactions with other users of the Platform, including any agreements, disputes, or claims arising from such interactions.

    • 9. Intellectual Property

    All content, trademarks, and materials on the Platform are the property of Seekr or its licensors and are protected by intellectual property laws. You may not use, copy, reproduce, or distribute any content from the Platform without prior written consent from Seekr.

    You agree not to use automated tools or software to access, scrape, or harvest data from the Platform.

    10. Termination

    Seekr reserves the right to suspend or terminate your access to the Platform at any time, without notice, for any reason, including violations of these Terms.

    Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination will remain in effect, including disclaimers, indemnities, and limitations of liability.

    11. Governing Law and Dispute Resolution

    These Terms are governed by the laws of India. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Chennai, India, in English.

    If arbitration is deemed unenforceable, disputes shall be submitted to the exclusive jurisdiction of the courts in Chennai, India.

    12. Modifications to Terms

    Seekr reserves the right to modify these Terms at any time. Changes will be posted on the Platform and will take effect immediately upon posting. Continued use of the Platform constitutes acceptance of the updated Terms.
